PARKER, Umpire, rendered the decision of the Commission.

This case is before the Umpire for decision on a certificate of the American Commissioner and the German Commissioner[b] certifying their disagreement.

The United States on behalf of Ellen Candlish individually and as Administratrix of the Estate of Arthur Candlish, Deceased, asserts this claim based on facts as disclosed by the record as follows:

Arthur Candlish, by naturalization an American citizen, with this claimant, his wife, who has remained an American national, took passage on the Lusitania. The claimant’s husband was lost, and she suffered exposure and injury to her leg, by reason of which she was unable to walk for six weeks.

Their personal effects which were lost were of the value of $682.00.

At the time his death Arthur Candlish was 33 years of age and employed as a mill hand at wages variously estimated at $9.00, $11.50, and $20.00 per week. He left surviving him a widow (this claimant), then 30 years of age, but no children, and also a father, then about 55 years of age, who subsequently died, and two stepsisters, to the support of none of whom, save his wife, did he contribute.

Claim is asserted for compensation for personal injuries suffered by the claimant as well as for losses sustained resulting from the death of her husband.

Applying the rules announced in the Lusitania Opinion and other decisions of this Commission to the facts in this case as disclosed by the record, the Commission decrees that under the Treaty of Berlin of August 25, 1921, and in accordance with the terms of the Government of Germany is obligated to pay to the Government of the United States on behalf of (1) Ellen Candlish individually the sum of ten thousand dollars ($10,000.00) with interest thereon at the rate of five per cent per annum from November 1, 1923, and (2) Ellen Candlish, Administratrix of the Estate of Arthur Candlish, Deceased, the sum of six hundred eighty-two dollars ($682.00) with interest thereon at the rate of five per cent per annum from May 7, 1915.
