PARKER, Umpire, rendered the decision of the Commission.

This case is before the Umpire for decision on a certificate of the American Commissioner and the German Commissioner[a] certifying their disagreement.

The United States on behalf of Terence Joseph Condon asserts this claim based on facts as disclosed by the record as follows:

The claimant, who was then and has ever since been an American national, was married to Della Doyle September 13, 1910. On February 8, 1911, claimant and his wife entered into a contract with the New York Foundling Hospital by the terms of which they conditionally adopted a female child, then one year eleven months of age, who has ever since been a member of claimant’s household. The claimant’s wife, Della, then 28 years of age, took passage on and went down with the Lusitania. The claimant was then 32 years of age. He was engaged in the commission business in New York. Whilst his earnings were not large, he, with his wife and adopted child, had a modest happy home presided over and cared for by his wife.

The decedent had with her on the Lusitania property which was lost of the value of $651.50. The claimant has incurred some expenses for a casket and embalming aggregating less than one hundred dollars.

Applying the principles and rules announced in the Lusitania Opinion and other decisions of this Commission to the facts in this case as disclosed by the record, the Commission decrees that under the Treaty of Berlin of August 25, 1921, and in accordance with the terms of the Government of Germany is obligated to pay to the Government of the United States on behalf of (1) Terence Joseph Condon the sum of ten thousand dollars ($10,000.00) with interest thereon at the rate of five per cent per annum from November 1, 1923, and (2) Terence Joseph Condon, Administrator of the Estate of Della Condon, Deceased, the sum of six hundred fifty-one dollars fifty cents ($651.50) with interest thereon at the rate of five per cent per annum from May 7, 1915.

  1. This stood out to me only because my Grandmas name was Odelia similar to this lady all I know for sure is my Grandma married Albert Collins\ Bert b Collins
