BY THE COMMISSION: –

This claim is put forward by Joseph E. Marks individually and also as administrator of the estate of his mother, Elizabeth Marks, and of the estate of his sister, Georgina Marks, both of whom were lost on the Lusitania. At the time the claimant was a subject of Great Britain. On April 14, 1916, he became, through naturalization, a citizen of the United States. According to the record no American national suffered damage as a result of the deaths of Elizabeth and Georgina Marks which can be measured by pecuniary standards.

Applying the rules and principles announced in the Lusitania Opinion, in Administrative Decision No. V, and in other decisions of this Commission to the facts as disclosed by this record, the Commission decrees that under the Treaty of Berlin of August 25, 1921, and in accordance with its terms the Government of Germany is not obligated to pay to the Government of the United States any amount on behalf of the claimants herein.
