PARKER, Umpire, rendered the decision of the Commission.

This case is before the Umpire for decision on a certificate of the two National Commissioners[a] certifying their disagreement.

From the record it appears that Patrick Callan, a naturalized American, then 46 years of age, was a passenger on and went down with the Lusitania. He was survived by a widow, Mary Callan, two sons, Peter M. Callan and Thomas Callan, and a daughter, Catherine Callan, aged 53, 21, 20, and 18 years respectively, all of whom were then and have since remained American nationals.

The deceased was by occupation a skilled laborer and foreman of laborers, and his wages averaged $1,500 per annum. Since his death wages paid the class to which he belonged, as well as living costs, have very substantially decreased. The deceased was the head of the household of which all of these claimants were members. At the time of his death his sons, Peter and Thomas, were self-supporting and contributing to the support of the family. The daughter Catherine was not at that time self-supporting but has been for some years past.

The money and personal effects lost with the deceased were of the value of $790.50.

Applying the rules announced in the Lusitania Opinion and in the other decisions of this Commission to the facts as disclosed by this record, the Commission decrees that under the Treaty of Berlin of August 25, 1921, and in accordance with its terms the Government of Germany is obligated to pay to the Government of the United States on behalf of (1) Mary Callan the sum of seven thousand five hundred dollars ($7,500.00), (2) Catherine Callan the sum of two thousand five hundred ($2,500.00), with interest on each of said sums at the rate of five per cent per annum from November 1, 1923, and (3) Peter M. Callan as Administrator of the Estate of Patrick Callan, deceased, the sum of seven hundred ninety dollars fifty cents ($790.50) with interest thereon at the rate of five per cent per annum from May 7, 1915; and further decrees that the Government of Germany is not obligated to pay to the Government of the United States any amount on behalf of Peter M. Callan and Thomas Callan.
